4. Violations & Cancellations
Belmares Studio® reserves the right to suspend, void, or cancel any order or purchase if a coupon is used:

• Fraudulently (with intent to deceive);

• Outside its validity period;

• In violation of stated terms; or

• In any unauthorized manner.

All product details displayed on the Belmares Studio® website, physical product displays, accompanying photographs or videos, as well as any commercial names, trademarks, or distinctive signs featured on the website are provided for general reference only. Belmares Studio® shall not be held liable for any errors or inaccuracies in product information.

All products featured on the Belmares Studio® website are subject to stock availability. Delivery times may vary and will be communicated to customers accordingly.

1. Payment Process

To complete a purchase, Users must pay for:

• Selected products

• Applicable taxes

• Shipping fees (freight costs)

Payment must be made through Belmares Studio®’s designated payment providers, available on the Belmares Studio® website.

2. Delivery Areas

• Products may only be delivered to addresses within Belmares Studio®’s current service areas at the time of purchase.

• Delivery coverage may vary by product.

3. Furniture Assembly & Delivery Conditions

• No assembly service: Belmares Studio® does not provide furniture assembly.

• User responsibility:

  • Measure your space (including doorways, staircases, and elevators) before purchasing.

  • Verify product dimensions to ensure they fit your intended location.

• Carrier discretion:

  • Delivery personnel may refuse to deliver if they determine a risk of damage to the product or property (e.g., narrow stairwells or elevators).

  • If the User insists on delivery despite carrier warnings, all liability for damage (to the product or property) falls solely on the User.

All product prices displayed on our website include VAT (Value Added Tax) and any other applicable taxes. Shipping fees (delivery costs) are not included in the listed prices and will be:

• Calculated separately for each order

• Clearly displayed during checkout

• Added to and payable as part of the total order amount

While Belmares Studio® strives to provide accurate pricing, errors may occur, including:

• Incorrect online pricing

• Mispriced items in physical stores

• Discrepancies between promotional and displayed prices

In such cases, Belmares Studio® reserves the right to:

1. Cancel or decline orders containing incorrectly priced items

2. Contact the User to request instructions or notify them of cancellation

3. Correct pricing in physical stores and deny sales at incorrect prices

4. Cancel orders (even if already confirmed or paid)

Special Pricing Cases

• 0.00or0.00or0.01 Prices: These are system errors. Users must contact Belmares Studio® Customer Service immediately. Orders placed at these prices will be canceled without notice.

• Online vs. In-Store Price Discrepancies:

  • Verify the product matches exactly (dimensions, color, materials)

  • Belmares Studio® may update the price to the correct authorized retail price

• Promotional Campaigns:

  • Some promotions apply only to:

    • Specific store locations

    • Limited quantities of selected items

  • Belmares Studio® may offer different prices for similar products not included in the promotion

4. Disputed Charges & Fraud Prevention

If a bank/financial institution disputes charges made on Belmares Studio®:

  • Permanently ban the User’s account without prior notice

  • Take legal action (civil/criminal penalties as applicable)

1. Delivery Address

Belmares Studio® will ship products only to the address specified during checkout. Any changes post-purchase may require order cancellation and re-submission.

2. Shipping Carriers

• Deliveries are handled by Belmares Studio® or third-party carriers ("Shipping Partners").

• By placing an order, Users agree to the shipping policies of these carriers, which are incorporated into these Terms.

3. Delivery Timeline

• Processing begins only after full payment confirmation (bank/online payment platform).

• Estimated delivery windows (shown on the website or in-store) are approximations only.

• Delays may occur due to:

  • Logistics issues

  • Force majeure events (e.g., natural disasters, strikes)

  • Belmares Studio® is not liable for delays beyond its control.

4. Furniture Delivery Conditions

• No assembly service is provided.

• User responsibility:

  • Measure doorways, staircases, and elevators before purchasing.

  • Confirm product dimensions to ensure they fit your space.

5. Delivery Requirements

• Government-issued ID (e.g., driver’s license, passport) must be presented upon delivery.

• Failed deliveries due to User error (e.g., wrong address, recipient unavailable) may incur additional shipping fees for re-delivery.

6. Inspection & Acceptance

• Users must inspect products immediately upon delivery.

  • If damaged/unsatisfactory: Refuse delivery and contact Belmares Studio® Customer Support at 554 783 5811.

  • Accepting delivery implies the product is in perfect condition and meets your expectations.

1. Production & Cancellation Timeline

• Production begins immediately after payment confirmation.

• 48-Hour Cancellation Window:

  • Customers may request full order cancellation within 48 hours (natural time) of payment.

  • After 48 hours, a 50% cancellation fee (of the pre-tax order total) will apply.

  • Products modified/repaired by unauthorized parties.

2. Warranty Claims Process

2. Coverage Area: Valid only within original delivery zones.

3. Time Limits:

   • Visible defects: Must be reported within 7 days of delivery.

   • Manufacturing defects: Up to 90 days.

3. Returns & Exchanges

• 7-Day Satisfaction Guarantee:

  • Products must be unused and in original condition.

  • Exchanges allowed for:

    • Same-priced items or

    • Higher-priced items (customer pays difference).

  • Subject to stock availability.

4. Limitations

• No Expanded Coverage: Warranty terms are non-negotiable and product-specific.

• Customer Responsibilities:

• No Refunds: Exchanges only (no cash reimbursements).

3. Exchange Options:

• No Stock Guarantee: Product availability fluctuates; Belmares Studio® is not obligated to stock exchange items.

• Non-Compliance Fees:

  • Returns initiated without prior approval may incur shipping/restocking fees.

1. Return Shipping Arrangements

Upon approval of your Return Request:

• Belmares Studio will coordinate product collection at the original delivery address.

• In select cases, a prepaid shipping label may be provided through our designated carrier.

2. Collection Terms

• All returns must be collected from the original delivery location unless prior arrangements are made.

• Alternate collection addresses must fall within Belmares Studio's active service areas.

3. Customer Requirements

• Products must be properly packaged for return shipment.

• Customers must be available during the scheduled collection window.

4. Important Notes

• Belmares Studio reserves the right to deny return collection for improperly packaged items.

• Failure to be available for scheduled collection may result in additional service fees.

En cualquier reclamación de garantía de los productos que hayan sido enviados fuera de nuestra área de cobertura por parte del cliente, en el entendido que, en el caso que aplique la devolución del producto, el cliente tendrá que enviarlo al destino original de entrega para poder realizar la recolecta del mismo. Cualquier daño o afectación al producto adicional que suceda durante esta transportación quedará fuera de la cobertura de garantía.

Una vez recibidos los productos devueltos por el Usuario, Belmares Studio® revisará a detalle los productos devueltos. En caso de que los productos recibidos por Belmares Studio® cumplan con las características establecidas en la sección “Condiciones de Cambio”, la Empresa tendrá la obligación de programar el cambio dentro de los siguientes 7 días hábiles en caso de tener inventario, de lo contrario se estipularán tiempos de mutuo acuerdo para el cambio de la o las piezas en proceso de cambio.

1. Invoice Requests

• Invoices for purchases made through Belmares Studio's website must be requested via email at contact@belmares.studio.

• Requirements for Processing:

  • Payment must be confirmed and validated.

  • Requests must be submitted within the same calendar month as the purchase date.

2. Request Submission

• Customers must select the invoice option during checkout on belmares.studio.

• The following tax details must be provided:

  • Tax ID (RFC with Homoclave)

  • Full legal name or business name

  • Complete tax address (street, neighborhood, municipality, state, and ZIP code)

  • Payment method (cash, bank transfer, debit/credit card, or other SAT-authorized electronic payment)

  • Last 4 digits of the payment account

  • Email for invoice delivery

3. Invoice Issuance

• Once issued, invoices cannot be reissued or modified.

• Invoices will be delivered via email within 48 to 72 business hours after request approval.

By using Belmares Studio's services, the User agrees to indemnify, defend, and hold harmless Belmares Studio®, including its subsidiaries, parent company, shareholders, directors, officers, employees, advisors, and agents, from and against:

• Any claims, lawsuits, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees)

• Any legal or regulatory violations related to:

  • (i) Breach of these Terms and Conditions

  • (ii) Violation of applicable laws, regulations, or decrees

2. Legal Defense Rights

• Belmares Studio® reserves the exclusive right to:

  • Assume full control of any legal defense related to User violations.

  • Settle or dispute claims at its sole discretion.

• The User must cooperate fully in such defenses, including providing necessary documentation and testimony.

Belmares Studio® reserves the right, at its sole discretion and without prior notice, to:

• Modify, improve, or update any content, features, services, databases, or functionality on its website.

• Adjust presentation formats, product information, or system interfaces as needed.

No User Entitlement:

• Such changes do not entitle Users to compensation, claims, or legal recourse.

• Modifications do not constitute an admission of liability toward any User.

Key Implications:

• Updates may occur without notification (Users are responsible for reviewing terms periodically).

• Continued use of the site constitutes acceptance of all modifications.

1. Effective Date and Duration

1. Entire Agreement

These Terms and Conditions of Use, along with any additional terms referenced herein, constitute the complete and exclusive agreement between Belmares Studio® and the User. This agreement supersedes and replaces all prior or contemporaneous understandings, arrangements, or agreements (whether written or oral) relating to the subject matter herein.

2. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law:

• Belmares Studio® reserves the right to modify or remove the affected provision to the minimum extent necessary to make it valid and enforceable.

• The United Nations Convention on Contracts for the International Sale of Goods (CISG) (expressly excluded)

• Any conflict-of-law principles that might apply the laws of another jurisdiction

Any disputes arising from or related to these Terms shall be exclusively resolved in the competent courts of Mexico City, Mexico.

3. Legal Effect of Assignment

• The assignee assumes all obligations, and Belmares Studio® is fully released from liability to the User.

• The User agrees to recognize and comply with the assignee’s authority.

The failure or delay by Belmares Studio®, its affiliates, or service providers to:

The User agrees to defend, indemnify, and hold harmless Belmares Studio®, its affiliates, suppliers, vendors, and advisors from and against:

• All claims, lawsuits, liabilities, and expenses (including reasonable attorneys’ fees and court costs) arising from:

Any violation of these Terms, including but not limited to:

• Unauthorized or non-compliant use of www.belmares.studio;

• Posting of defamatory, libelous, or unlawful content on the Website.

2. Intellectual Property Violations

Infringement of applicable laws or international treaties regarding:

• Copyrights or intellectual property rights of content on the Website.

3. Scope of Coverage

This indemnification applies to:

• Direct and indirect damages (e.g., legal fines, reputational harm);

• Third-party claims (e.g., lawsuits from other users or rights holders).
